Terms of Service

1. Acceptance of Terms

By creating an account or using the GIL mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and GIL LTD, a company registered in England and Wales, and 길 (GIL) registered in South Korea (collectively, "GIL", "we", "us", or "our").

2. The Service

GIL is a platform that connects travellers ("Explorers") with local residents ("Scouts") to create customized, locally-curated tour experiences.

GIL is a marketplace. We facilitate introductions, communication, booking, and payment between Explorers and Scouts. We do not:

  • Employ, certify, or license Scouts
  • Provide tour services directly
  • Guarantee the quality, safety, or accuracy of any tour
  • Act as a travel agency, tour operator, or guide service
  • Supervise or control any in-person interaction between users

Scouts are independent individuals, not employees, agents, or representatives of GIL.

3. Eligibility

To use the Service, you must:

  • Be at least 14 years of age
  • Provide accurate and complete information at registration
  • Have the legal capacity to enter into a binding agreement

By creating an account, you confirm that you meet these requirements. We verify age via a required birthday at signup. This field cannot be changed after account creation.

To register as a Scout, you must:

  • Be at least 18 years of age (or 19 in South Korea)
  • Complete identity verification via our third-party provider (Stripe Identity)

4. Your Account

You are responsible for:

  • Maintaining the accuracy of your profile information
  • Keeping your login credentials secure
  • All activity that occurs under your account

You may not:

  • Create multiple accounts
  • Share your account with others
  • Transfer your account to another person

5. Explorer Responsibilities

As an Explorer, you agree to:

  • Provide accurate tour requests, including budget, dates, and preferences
  • Respond to Scout offers in a timely manner
  • Show up to confirmed tours on time and at the agreed location
  • Treat Scouts with respect and courtesy
  • Pay the agreed amount for confirmed tours
  • Not request services that are illegal in the destination country
  • Comply with local laws and customs during tours

6. Scout Responsibilities

As a Scout, you agree to:

  • Complete identity verification before submitting offers
  • Provide accurate and honest tour descriptions and pricing
  • Deliver the tour experience as described in your accepted offer
  • Maintain appropriate and professional conduct during tours
  • Not misrepresent your qualifications, knowledge, or experience
  • Comply with all applicable local laws and regulations
  • Not offer services that require professional licensing or certification that you do not hold

Scouts are not certified tour guides. You must not represent yourself as a licensed, certified, or official guide unless you hold such credentials independently.

7. Bookings and Payments

7.1 How Bookings Work

  • Explorers submit tour requests with a budget
  • Scouts review requests and submit offers with a final price
  • Explorers choose and accept an offer
  • Upon acceptance, payment is processed

7.2 Payment Processing

All payments are processed through Stripe, our third-party payment partner.

GIL does not collect or store card numbers, bank details, or payment credentials. All payment data is handled by Stripe.

7.3 Service Fee

GIL charges a service fee on completed tours. The applicable fee is disclosed to both parties before a booking is confirmed.

7.4 Deposit

A deposit is required when you submit a tour request. The deposit amount is displayed at the time of submission and forms part of the total tour price — it is not a separate or additional fee.

Once a Scout's offer is accepted, you pay the remaining balance (the total tour price minus the deposit already paid). Together, the deposit and balance make up the full tour price.

If no Scout's offer is accepted within 48 hours of your request, the request expires and the deposit is fully refunded. If you withdraw your request before accepting any offer, the deposit is fully refunded, regardless of whether any Scout has submitted an offer.

After a tour is confirmed (i.e. an offer has been accepted), refunds follow the cancellation policy in Section 8.

7.5 Scout Payouts

Scout payouts for completed tours are processed via Stripe. Payout timing and methods are subject to Stripe's terms and processing schedules.

8. Cancellation and Refunds

8.1 Explorer Cancellations

Before a tour is confirmed:If you withdraw a submitted tour request before accepting any Scout's offer, or if your request expires because no offer was accepted within 48 hours, you receive a full refund of your deposit.

After a tour is confirmed:Once you accept a Scout's offer, refund amounts depend on when you cancel relative to the tour start date. Refunds apply to the full tour price, including the deposit:

  • More than 7 days before the tour: full refund (100%)
  • Between 48 hours and 7 days before the tour: 50% refund
  • Less than 48 hours before the tour: no refund

8.2 Scout Cancellations

If a Scout cancels a confirmed tour:

  • The Explorer receives a full refund
  • The Scout's reliability record may be affected
  • Repeated cancellations may result in account suspension

8.3 No-Shows

  • If an Explorer does not show up: no refund
  • If a Scout does not show up: full refund to the Explorer, and the Scout's account may be suspended

8.4 Disputes

If you believe a refund is warranted outside the standard policy (e.g., the tour was materially different from what was described), contact us at privacy@gilltd.com. We will review the circumstances and may issue a partial or full refund at our discretion.

8.5 Refund Processing

Refunds are processed through the original payment method. Processing times depend on your payment provider and may take 5–10 business days.

9. Reviews

After a completed tour, both Explorers and Scouts may leave reviews for each other.

When leaving a review, you agree to:

  • Provide honest and accurate feedback
  • Base your review on your actual experience
  • Not include personal attacks, discriminatory language, or threats
  • Not offer or accept compensation in exchange for reviews

Reviews are public and attributed to your username. Private feedback is visible only to the recipient.

We reserve the right to remove reviews that violate these guidelines.

10. Prohibited Conduct

You may not use the Service to:

  • Harass, threaten, intimidate, or abuse any user
  • Discriminate against users based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic
  • Post false, misleading, or deceptive information
  • Impersonate any person or entity
  • Solicit personal contact information to circumvent the platform (e.g., arranging tours outside GIL to avoid fees)
  • Engage in any illegal activity
  • Spam, scam, or defraud other users
  • Upload malicious content or attempt to compromise the Service
  • Create fake accounts or manipulate reviews
  • Use the Service for any purpose other than its intended function

11. Content Ownership and Licence

11.1 Your Content

You retain ownership of content you create on the Service (tour requests, offers, reviews, messages, profile information). By posting content, you grant GIL a worldwide, non-exclusive, royalty-free licence to use, display, and distribute your content as necessary to operate the Service.

11.2 Anonymized Content

If you delete your account, content you shared with other users (messages, reviews, tour records) may be anonymized rather than deleted, as described in our Privacy Policy. Anonymized content cannot be linked back to you.

11.3 GIL Content

All trademarks, logos, designs, and proprietary materials on the Service are owned by GIL LTD. You may not copy, modify, or distribute GIL's intellectual property without permission.

12. Reporting and Enforcement

12.1 Reporting

If you experience or witness a violation of these Terms, you may report the user through the in-app reporting feature or by contacting privacy@gilltd.com.

Reports are reviewed by our team. The reported user will not be informed of who submitted the report.

12.2 Enforcement Actions

We may, at our discretion:

  • Issue a warning
  • Temporarily suspend an account
  • Permanently terminate an account
  • Remove content that violates these Terms
  • Withhold or reverse payments in cases of fraud

We are not obligated to provide advance notice before taking enforcement action, though we will endeavour to explain our reasoning when possible.

13. Account Deletion

You may delete your account at any time through the Privacy & Data section in Account Settings.

Upon deletion:

  • Your account enters a 30-day recovery period during which you can restore it by signing back in
  • Personal data (profile image, notifications, feedback, activity logs) is removed immediately
  • After 30 days, your account and remaining personal data are permanently deleted
  • Content shared with other users (messages, reviews, tour records) is anonymized
  • Payment records are anonymized and retained for legal compliance

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any Scout will meet your expectations
  • Any tour will be safe, enjoyable, or as described
  • Any information provided by users is accurate or reliable

GIL does not verify the accuracy of tour descriptions, Scout qualifications (beyond identity verification), or Explorer representations. You use the Service and participate in tours at your own risk.

You acknowledge that tours involve in-person meetings between strangers and may carry inherent risks including, but not limited to, personal injury, property damage, or theft. GIL strongly encourages users to exercise caution and good judgement.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  • GIL is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service or participation in any tour
  • GIL is not liable for the actions, omissions, or conduct of any user, whether online or in person
  • GIL's total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to GIL in service fees during the 12 months preceding the claim

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

16. Indemnification

You agree to indemnify and hold harmless GIL, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law
  • Any tour you participate in, whether as an Explorer or Scout
  • Any content you post on the Service

17. Dispute Resolution

17.1 Between Users

Disputes between Explorers and Scouts (e.g., regarding tour quality, refunds, conduct) should first be resolved directly between the parties via the in-app chat.

If direct resolution fails, either party may contact GIL at privacy@gilltd.com. We may, at our discretion, mediate the dispute, but we are not obligated to resolve disputes between users.

17.2 Between You and GIL

Any dispute arising from these Terms or the Service that cannot be resolved through informal communication shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you retain the right to bring proceedings in your country of residence.

If you are a consumer in South Korea, disputes may be resolved through the Korea Consumer Agency or the courts of South Korea, as applicable under Korean law.

18. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

If you are a consumer in the EU, South Korea, Japan, or Vietnam, mandatory consumer protection laws of your country of residence will apply to the extent they override these Terms.

19. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via the app and/or email at least 30 days before taking effect.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GIL regarding the Service, superseding any prior agreements.
